Bankruptcy Counseling Services Available Through CCOA
As part of your bankruptcy process, you have to complete a counseling session prior to filing your bankruptcy. This session will last approximately an hour and 15 minutes. Upon completion of the counseling session, a certificate can be provided to you or to your attorney. The certificate is valid for 180 days from the date of the counseling session.
Payment ($50 per session) can be made via debit card, personal check or money order. Counseling services are offered to clients without regard to ability to pay.
If you are a homeowner, and your mortgage payment is the primary reason you are seeking bankruptcy assistance, you may want to be aware of the possible solutions under the Home Affordable Modification Program (HAMP). After you have filed for bankruptcy, you are required to go through your pre-discharge education class, which we offer online. The education is a minimum of 2-hours. You will need to read, complete, sign, date, and return a disclosure & affidavit form before getting started.
CCOA must receive the affidavit form and payment ($50.00 for an individual, $60.00 for couple) before completing the education. As with the pre-filing session, the course is offered to debtor students without regard to debtor students ability to pay.
Limited English proficient clients/debtors may take the online education in Spanish. Clients will only receive certificates if client completes instruction. Upon completion of the course, CCOA is obligated to provide a certificate of course completion to the debtor student promptly within three business days. Fee Waiver Policy
If a client’s household gross monthly income is 150% or less than the poverty guidelines provided by the U.S. Department of Health and Human Services (adjusted for family size), they are eligible for a fee waiver.
CCOA will also waive the fee if your attorney is providing services pro bono.
